Terms of Use

1. Who operates CartCompare

CartCompare is operated by Jellie UK Limited ("Jellie", "CartCompare", "we", "us" or "our"). By accessing or using CartCompare, including by continuing past the first-use notice, you agree to these Terms of Use and our Privacy Policy.

If you do not agree, you must not use CartCompare.

2. Defined terms

• Users means people or organisations who access or use CartCompare.
• Retailer Partners and Sources means, as a generic descriptive label, third-party retailers, marketplaces, brands, grocers, merchants, affiliate networks, product data providers, delivery providers, payment providers, review providers and any other third-party destination, feed, API or source referenced, searched, compared or linked through CartCompare. Use of this label does not mean there is a legal partnership, agency, endorsement, sponsorship or commercial relationship with Jellie unless we expressly say so in writing.
• Listing Data means product names, prices, product images, promotions, loyalty prices, availability, stock, retailer links, identifiers, metadata and related factual comparison information obtained from or associated with Retailer Partners and Sources. CartCompare does not intend to republish retailer logos, reviews, ratings, long-form descriptions or marketing copy unless expressly enabled or permitted.
• Service means CartCompare and its website, tools, software, interfaces, reports, content, APIs and related features.

3. Beta and informational-only status

CartCompare is currently provided as a Public beta. Features, Retailer Partner or Source coverage, connectors, OCR/list extraction, ranking logic, match scoring, basket handoff and availability checks are experimental and may change, fail, be withdrawn or return incomplete results at any time.

CartCompare is an informational discovery and comparison tool only. It is not a retailer, broker, agent, reseller, payment processor, delivery provider, professional adviser or product safety authority.

4. No purchase contract with CartCompare

Any purchase, return, refund, warranty, delivery, loyalty-card arrangement, promotion, payment, chargeback, customer service issue or dispute relating to a product or order is solely between the User and the relevant Retailer Partner or Source.

CartCompare does not control Retailer Partner or Source checkout pages, prices, stock, substitutions, delivery windows, eligibility rules, returns, warranties, payment decisions or fulfilment. You must verify all final details on the Retailer Partner or Source before placing an order.

5. Listing Data accuracy and availability

Listing Data is sourced from Retailer Partners and Sources, automated matching, public pages, APIs, feeds or other third-party sources. It is intended to support factual price comparison and product identification, and may be delayed, incomplete, duplicated, mismatched, unavailable, out of date or wrong.

Without limitation, CartCompare does not guarantee the accuracy of prices, stock, promotions, loyalty prices, basket totals, images, product attributes, allergens, dietary information, safety information, delivery details, retailer links or match percentages.

You must not rely on CartCompare as the final source of truth for any purchase decision.

6. User responsibilities

• Use CartCompare only for lawful, personal or internal business comparison purposes.
• Check final price, stock, quantity, product identity, suitability, allergens, safety warnings, delivery, returns and checkout terms directly on the Retailer Partner or Source.
• Do not submit sensitive personal data, confidential information, private documents, payment card details, passwords, health data or information about unrelated people in searches, baskets, images, feedback or forms.
• Do not misuse, overload, probe, scrape, reverse engineer, bypass security, interfere with, copy at scale, resell access to or attempt unauthorised access to the Service.
• Do not use CartCompare to create misleading comparisons, unlawful content, harmful automation, spam, fraud or activity that may damage Jellie, Users, Retailer Partners and Sources or any third party.
• Keep your own devices, browser, accounts and local storage secure.

7. Retailer Partner or Source rights and independence

Retailer Partners and Sources are independent third parties. They are not owned, controlled, endorsed by, affiliated with or responsible for CartCompare unless expressly stated in a written agreement with Jellie.

All Retailer Partner or Source names, trademarks, product images and other Listing Data remain the property of their respective owners or licensors. References to Retailer Partners and Sources are used for identification, comparison, linking, factual description and user navigation only. Product images may be displayed as small thumbnails to help users identify products and compare factual pricing information; CartCompare does not claim ownership of third-party product images, retailer names, brands or trademarks.

CartCompare does not intend to display retailer logos unless licensed, approved or otherwise permitted. Retailer Partners, Sources, brand owners, licensors or authorised representatives may request review of inaccurate, outdated, sensitive or rights-restricted Listing Data by contacting us through the Contact page. Requests should include proof of ownership or authority to act, the affected CartCompare/result URL, the relevant retailer/product URL, and the requested action, such as removal, correction, attribution change or source exclusion. We may correct, hide, limit, attribute, disable or remove Listing Data or links at our discretion while reviewing valid requests, but we do not accept an obligation to monitor all third-party data continuously.

8. User rights

Nothing in these terms is intended to remove rights that cannot legally be excluded, including applicable UK consumer rights, data protection rights, rights to contact a Retailer Partner or Source about an order, or rights to raise privacy, access, correction or deletion requests with us as described in the Privacy Policy.

You may stop using CartCompare at any time. You can reject analytics cookies through the consent banner and clear local browser storage to remove local acknowledgement/consent state.

9. Search, OCR and uploaded content

If you type basket/list entries or upload an image for OCR, you confirm that you have the right to submit that content and that it does not contain unlawful, confidential or sensitive material. OCR output may be inaccurate and must be checked by you.

You grant Jellie a limited right to process submitted content for operating, securing, debugging, improving and evidencing the Service, consistent with our Privacy Policy.

10. Analytics, consent and service data

CartCompare may use consent-based analytics and essential technical logging to operate, secure and improve the Service. Categories of information currently collected or processed are outlined in the Privacy Policy and may include searches, basket/list inputs, OCR-derived text where used, interaction events, device/browser context, diagnostics, errors and contact form submissions.

Analytics consent is separate from marketing consent. Rejecting analytics does not prevent essential security, functionality or legal/audit processing where permitted by law.

11. Intellectual property

The CartCompare name, design, software, ranking logic, UI, copy, reports, databases, selection/arrangement of data and original content belong to Jellie or its licensors and are protected by intellectual property and database rights where applicable.

You may use the Service through the normal website interface. You must not copy, reproduce, redistribute, frame, commercially exploit, train models on, benchmark publicly, or create derivative services from CartCompare content or outputs except as permitted by law or agreed in writing.

12. Acceptable use and suspension

We may block, throttle, suspend or terminate access, remove content, disable features or take technical/legal steps where we reasonably believe there is misuse, legal risk, security risk, excessive load, suspected fraud, infringement, inaccurate data risk, or conduct harmful to Jellie, Users, Retailer Partners and Sources or third parties.

13. No warranties

To the fullest extent permitted by law, CartCompare is provided "as is" and "as available". We make no warranty that the Service, Listing Data, links, connectors, rankings, match scores, OCR, basket totals or Retailer Partner or Source handoffs will be accurate, complete, uninterrupted, secure, compatible, timely or error-free.

14. Limitation of liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under applicable law.

Subject to the above, and to the fullest extent permitted by law, Jellie UK Limited will not be liable for:

• losses caused by inaccurate, delayed, incomplete, unavailable or mismatched Listing Data;
• Retailer Partner or Source price changes, stock changes, substitutions, delivery issues, payment failures, rejected discounts, loyalty-card differences, returns, refunds or customer service decisions;
• failed, delayed or incorrect links, basket handoffs, OCR extraction, search results, recommendations, rankings or match percentages;
• loss of profit, revenue, savings, goodwill, opportunity, data, business, reputation or anticipated benefit;
• indirect, consequential, special, incidental, punitive or exemplary loss;
• losses arising from User-submitted content, misuse, unauthorised access, third-party systems, outages, malware, scraping, automation or events outside our reasonable control.

Where liability cannot be excluded but can be limited, our total aggregate liability arising from or relating to the Service will be limited to the greater of: (a) the amount you paid directly to Jellie for the relevant Service in the 12 months before the claim; or (b) £100.

15. Indemnity for misuse

If you are using CartCompare on behalf of a business or organisation, you agree to indemnify Jellie against losses, claims, costs and expenses arising from your unlawful use, misuse, breach of these terms, infringement of third-party rights, or content/data you submit. This does not affect non-excludable consumer rights.

16. Changes, withdrawal and availability

We may change, correct, suspend, withdraw, replace or limit any part of CartCompare, these terms, the Privacy Policy, analytics events, Retailer Partner or Source coverage, data sources or features at any time. We may update these terms by publishing a revised version on the website.

17. Reporting issues and takedown requests

Users and Retailer Partners and Sources can report inaccurate data, rights concerns, privacy issues, harmful content or legal requests through the Contact page. Retailers, rights holders, licensors and authorised representatives should provide reasonable evidence of ownership or authority, affected URLs, the basis of the request, and the requested action. We may reject incomplete or unverifiable requests, ask for further evidence, or take interim steps where appropriate. We reserve the right to decide the appropriate correction, attribution, limitation, source exclusion or removal action.

18. Governing law

These terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, except where mandatory consumer law gives you the right to bring proceedings elsewhere.
